Question: Is it possible the Blood alcohol test might come below the legal limit for my DUI in Burbank, CA? I don?t know what the results were, but the officer wrote .08% BAC on the ticket for my DUI.
Answer: Anything is possible. Did you perform a breath test or blood test? If you performed a breath test and the officer wrote .08% or higher, than it is probably likely that you were .08% or higher as far as they are concerned. Keep in mind just because the breath machine says you were a .08%, it doesn?t necessarily mean that you were. You should speak to a DUI attorney about this in more detail.
